Supreme Court Condems Calcutta High Court On Referral To Mediation without Consent of Parties

The Supreme Court criticized the Calcutta High Court for ordering mediation in a contempt case without both parties' consent.

SC set aside the High Court's decision and emphasized that mediation requires mutual agreement and cannot be imposed and instructed the state to comply with the February 10, 2020, mandamus writ.

The Chief Secretary of West Bengal must execute the sale deed as per the High Court’s order.

If the government fails to comply, the Chief Secretary must personally appear before the Supreme Court on March 3, 2025, to explain why contempt action should not be taken.
