SC Criticizes Conversion of Civil Disputes into Criminal Cases in UP

Petitioner Rikhab Birani challenged charges under Sections 420,  406, 354, 504, and 506 IPC, arising from the complaint alleging fraud in a Rs. 19 lakh sale deed transaction.

The Supreme Court expressed concern over the growing trend of converting civil disputes into criminal cases, particularly in Uttar Pradesh. The Court emphasized the need for strict scrutiny, noting that the respondent's counsel did not confirm the filing of any civil suit.

Consequently, the Court extended the interim stay on the criminal trial and directed the complainant to file a counter within three weeks. The matter will be heard again in March 2025.
