Supreme Court Criticizes Lower Courts for Framing Lesser Charge in Honour Killing Case

The Supreme Court set aside the judgments of the trial court and the Allahabad HC for framing charges under Section 304 IPC (culpable homicide not amounting to murder) instead of Section 302 IPC (murder).

The case involved a 19-year-old boy from a different religion who was beaten to death by his girlfriend’s family. The girl’s father and uncle were accused of assaulting him with iron rods after luring him to their home.

The Bench emphasized that the injuries revealed in the post-mortem, including neural hematoma, pointed to an intentional act of murder.

The Court ordered fresh charges under Section 302 IPC, directing that the trial proceed accordingly.
