SC Criticizes the Practice of Arresting Accused Individuals After The Filing of a Charge Sheet

  • Case Name: Musheer Alam v. State of Uttar Pradesh
  • Judge(s): Justice JB Pardiwala, Justice R Mahadevan

The Supreme Court criticized Uttar Pradesh police for arresting the accused person after the chargesheet was filed, calling it "unusual" and "senseless."

The Court emphasized that arrests should occur during investigations, not after filing the chargesheet.

The bench noted that accused individuals should be summoned to court and granted bail, provided they cooperate.

Referring to Siddharth v. State of UP (2021) and Satender Kumar Antil v. CBI (2021), the Court reiterated that arrests after chargesheet filing are unwarranted.

In this case, under the Prevention of Corruption Act, the court granted bail as the accused had cooperated during the investigation.
