The Supreme Court has struck down its earlier direction (from September 12, 2025) that Nirmal Kanti Chakrabarti, the former Vice-Chancellor of NUJS, include a sexual harassment complaint in his professional records.
The Court said the complaint had been rejected as time-barred under the POSH Act, and no factual investigation was carried out, making the prior order a form of “stigmatic punishment.”
Allowing his expunction application, the Bench held that a public record of the complaint was unwarranted without any merit-based finding.
