Supreme Court Differentiates Lease from Allotment in Land Dispute

  • Case Name: Dalip Ram v. State of Punjab & Ors
  • Judge(s): Justice C.T. Ravikumar and Justice Rajesh Bindal

The Supreme Court, in Dalip Ram v. State of Punjab & Ors., reaffirmed the distinction between "lease" and "allotment." A lease grants temporary possession, while an allotment does not include a formal lease grant.

Addressing disputes over Shamlat Deh Lands under the Punjab Village Common Lands (Regulation) Act, 1961, the Court upheld the High Court's finding that the lands in question belonged to the Gram Panchayat.

The appellant, whose father held a lease that expired in 1971, failed to prove ownership or allotment. The Court dismissed his appeal, emphasizing the lack of evidence to challenge the Gram Panchayat's title.
