The Supreme Court asked a special bench to review its 2017 Indira Jaising v. Supreme Court decision on how lawyers are given the title of Senior Advocate.
The case challenges whether the current system of selecting Senior Advocates is fair under Article 142 of the Constitution.
Solicitor General Tushar Mehta said that choosing Senior Advocates should be fair and clear, judges shouldn’t make the decision alone, and there should be no favoritism or influence in the process.
He suggested selecting Senior Advocates based on court performance, not fame.
The Court will review if changes are needed while keeping it fair.
