
The Supreme Court set aside a Madhya Pradesh High Court order that denied promotion to a cooperative society employee, ruling that withholding educational relaxation granted to others is discriminatory.
The Court found that the employee, who served for 28 years, was recommended for the post of Society Manager by the Board of Directors under service rules allowing relaxation for experienced staff.
The Court observed that "discrimination is the other name of injustice," holding that the Registrar could not disapprove a valid resolution.
Emphasizing that denying equal treatment violates Articles 14 and 16 of the Constitution when similarly situated candidates were promoted.
