The Supreme Court raised compensation to Rs. 1.5 lakh for a 39-year-old diamond cutter who lost vision in one eye due to a motor accident caused by a negligent auto-rickshaw driver.
Initially assessed at 49% disability by the tribunal and later revised to 65% by the High Court, the Court deemed the impairment 100% given the precision required in diamond cutting.
It emphasized that "pain and suffering" extend beyond physical pain, including loss of economic and social aspirations.
Citing Muralidhar v. R. Subbulakshmi, the Court highlighted the inadequacy of the Rs. 50,000 awarded earlier and upheld the appellant's professional and personal loss.
