Supreme Court Establishes Alimony Guidelines

  • Case Name: Praveen Kumar Jain v. Anju Jain
  • Judge(s): Justices Vikram Nath and Prasanna B Varale
  • Advocate(s): Ms. Mukta Gupta & Mr. Sanjay Jain

Following the suicide of Bengaluru techie Atul Subhash, who alleged harassment from his wife, the Supreme Court outlined guidelines for permanent alimony.

The main question was how to decide fair alimony when there are allegations of law misuse. The ruling aims to address concerns about the misuse of dowry laws and ensure fairness in family law.

The court said that alimony should help the wife live comfortably but should not unfairly punish the husband. This decision responds to public concern about the misuse of dowry laws.

The court outlined eight factors to consider when deciding alimony amounts, aiming for fairness for both sides.
