Supreme Court Flags Concerns Over Governors Withholding Bills Under Article 200

During the Presidential Reference hearing on assent to bills, the Supreme Court raised concerns over the interpretation of Article 200 that allows Governors to withhold bills without returning them to the Assembly.

Justice P.S. Narasimha warned this could even block money bills, calling the view “problematic.” 

Senior Advocate Harish Salve argued that withholding was a fourth option available to Governors, apart from assent, return, or reservation. However, Solicitor General Tushar Mehta countered that Article 207 prevents such misuse, as money bills require the Governor’s prior recommendation.

The Constitution Bench continues to deliberate on the scope of gubernatorial powers.
