Foreigners Tribunal Has No power to Review Its Own Orders : Supreme Court

The Supreme Court ruled that a Foreigners Tribunal cannot review its own orders, setting aside a review order passed in 2019 tribunal decision that reopened a settled case concerning Rejia Khatun's citizenship.

In 2018, the tribunal declared her an Indian citizen, and the State did not challenge this ruling.

However, in 2019, a fresh reference led to the case being reopened.

The Court held that tribunals lacked appellate power over their own judgments and criticized the Gauhati High Court for upholding the second order.

It also barred the State and Union from challenging the 2018 ruling, emphasizing the finality of the judgment.
