The Supreme Court has granted bail to five accused, Gulfisha Fatima, Meeran Haider, Shifa Ur Rehman, Mohammad Salim Khan, and Shadab Ahmad, in the February 2020 Delhi riots “larger conspiracy” case, while denying bail to Umar Khalid and Sharjeel Imam.
The Bench held that Umar Khalid and Sharjeel Imam stood on a “higher footing in the hierarchy of participation”, warranting continued custody at this stage.
However, bail was granted to the five co-accused subject to 11 strict and unprecedented conditions, reflecting the Court’s attempt to balance personal liberty with concerns of public order and trial integrity.
