The Supreme Court has imposed a ₹50,000 cost on the Bar Council of Maharashtra and Goa (BCMG) for entertaining a frivolous complaint against an advocate.
A Bench of Justices Vikram Nath and Sandeep Mehta passed the order while hearing BCMG’s appeal against a Bombay High Court order that stayed disciplinary proceedings against the advocate.
The complaint alleged misconduct in connection with settlement terms in a 1985 civil suit.
The High Court noted that the complainant and his family were not parties to the original suit, and prima facie, no fraud was attributable to the advocate.
