The Supreme Court has issued notice in a plea challenging the maintainability of a live-in partner’s application for maintenance under Section 125 CrPC.
A bench of Justices Pankaj Mithal and Prasanna B. Varale heard the appeal against a Kerala High Court order which had upheld the woman’s claim, observing that long cohabitation raises a presumption of marriage.
The petitioner argued that live-in partners cannot seek relief under Section 125.
The Court has sought the respondent’s reply within six weeks.
