
The Supreme Court has issued notice on a plea seeking reservation for Persons with Benchmark Disabilities (PwD) in appointments to the posts of Additional Government Pleader and Additional Public Prosecutor.
The petitioner, a practising advocate with 19 years’ experience and a benchmark disability, argued that Section 34 of the RPwD Act mandates 4% reservation in all government posts.
The Kerala High Court had rejected her plea, holding that these posts were not cadre posts and appointments were based on the government’s discretion as a “client”.
Challenging this, she contends the statute does not distinguish between permanent or contractual posts.
