Supreme Court Issues Notice on Vedanta’s Appeal Over Interest on Delayed Export Duty Refund

The Supreme Court issued notice on Vedanta Limited’s civil appeal challenging a Calcutta High Court judgment that denied interest on a delayed refund of export duty.

The High Court had held that interest under the Customs Act becomes payable only after a valid statutory refund application is filed.

It found that Vedanta’s refund was sanctioned and released within the prescribed three-month period under Sections 27 and 27A of the Customs Act, and therefore did not attract interest.

The Supreme Court condoned the delay and directed issuance of notice, returnable in six weeks.
