Supreme Court: Lawyers Must Cite Judgments that Oppose their Case too

The Supreme Court ruled that advocates must cite all relevant judgments to the court, including those that oppose their case.

The Bench observed that both lawyers and judges share a joint responsibility to avoid mistaken rulings and ensure consistency, especially since multiple benches pass conflicting orders daily.

The Court held that medical insurance payouts cannot be deducted from compensation awarded by a Motor Accident Claims Tribunal.

Clarifying that statutory compensation under the Motor Vehicles Act and contractual benefits under a private Mediclaim policy operate in completely separate legal fields, and denying recovery would unfairly penalize a policyholder's financial planning.
