Stay in Azure–PPL Copyright Dispute Applies Only to Parties Involved, does Not Apply to Third Parties: SC

  • Case Name: Phonographic Performance Ltd V. Azure Hospitality Private Ltd

The Supreme Court has clarified that its April 21 stay order in the copyright case between Azure and PPL Ltd. applies only between those two parties and does not extend to third parties or affect general licensing obligations.

The issue had started when Azure objected to PPL's terms of licensing, leading to interim orders by the Delhi High Court.

However, some establishments ceased paying licensing fees after a stay from the Supreme Court, by misinterpreting the order as a general exemption.

PPL, therefore, applied for clarification from the Supreme Court. The Court stated that the stay is specific to Azure and PPL, and third parties are still required to adhere to general licensing terms under copyright legislation.
