
The Supreme Court ordered the immediate release of law student Aniket, held under preventive detention for nearly a year under Section 3(2) of the National Security Act, 1980.
The Court held that the repeated extensions of Aniket’s detention were unjustified and lacked independent application of mind.
His detention was based on an FIR for attempt to murder following a campus altercation, despite being granted bail in that case and acquitted in five prior ones.
Finding no valid grounds for continued custody, the Court declared the NSA detention unlawful. A detailed order will be issued separately.
