Right to Access Justice Not Absolute: Supreme Court Penalizes Frivolous Litigant with ₹1 Lakh Cost

  • Case Name: Pamdurang Vithal Kevne v. Bharat Sanchar Nigam Limited
  • Judge(s): Justices J.K. Maheshwari and Rajesh Bindal

The Supreme Court imposed ₹1 lakh costs on a petitioner for abusing the judicial process with over 10 frivolous cases across 11 years, including before the Bombay High Court and the Supreme Court.

The Bench emphasized that the right to access justice is not absolute and condemned such misuse for “polluting the stream of justice.”

Citing Subrata Roy Sahara (2014), Dalip Singh v. State of UP (2010), and K.C. Tharakan v. SBI (2023), the Court upheld earlier rulings underlining misconduct and dismissed the petition, terming it a burden on genuine litigants seeking justice.
