The Supreme Court of India has overturned the conviction of an individual who had been sentenced for rape and kidnapping, highlighting that he is now married to the victim and they share four children.
The Court pointed out that pursuing the prosecution further would interfere with their family life and negatively impact the well-being of their children.
The Court also cited K. Dhandapani vs State by the Inspector of Police (2022) and Dasari Srikanth vs State of Telangana (2024) case, wherein similar facts arose, and the Court invoked its power under Article 142 for quashing the appellant-accused's conviction.
