Supreme Court Questions Gujarat Court’s 3-Year Sentence for Rape, Calls It Shocking

The Supreme Court expressed shock over a Gujarat trial court imposing only three years of imprisonment for rape under Section 376 of the Indian Penal Code,(Sec. 64 of BNS) despite the pre-2013 amendment minimum punishment being seven years.

A bench criticized the Gujarat High Court for failing to correct this error while dismissing appeals by both the convict and the State.

The State's counsel acknowledged the trial court's "serious error" but was unsure how to address it.

The apex court has scheduled the case for a detailed review on January 23, 2025.
