The Supreme Court set aside an Allahabad High Court order granting bail to a man accused of strangling his wife within three months of marriage, terming it “most shocking and disappointing.”
Justices JB Pardiwala and KV Viswanathan held that the High Court granted bail mechanically, relying only on custody since July 27, 2025, and absence of criminal history.
The Supreme Court said the High Court ignored crucial factors, including the gravity of dowry death, punishment under the BNS, marital relationship, place of occurrence, medical evidence, and the statutory presumption under Section 118 of the Bharatiya Sakshya Adhiniyam.
Bail was cancelled and surrender directed.
