
The Supreme Court on Monday issued notices to the Central government and all States regarding petitions challenging the constitutional validity of the Transgender Persons (Protection of Rights) Amendment Act, 2026.
A Bench of CJI Surya Kant and Justice Joymalya Bagchi declined to grant an interim stay on the legislation, which replaces self-identification with mandatory medical evaluation.
Petitioners, represented by Senior Advocate AM Singhvi, argued the law nullifies the NALSA judgment and halts ongoing gender-affirming treatments.
Conversely, the Solicitor General maintained the Act prevents forceful gender changes. The matter will now be heard by a three-judge Bench.
