The Supreme Court dismissed a plea filed by law firm Fox Mandal & Co in a ₹3.9 crore service tax dispute from the pre-GST period (2010–2015).
The firm had challenged an order of the CESTAT, particularly the scope of remand in the case. The dispute arose due to allegations of unpaid service tax and irregular use of CENVAT credit.
The Court refused to interfere and upheld the tribunal’s decision to send the matter back for reconsideration.
This means the case will continue before the appropriate authority, and the firm must now contest the issues at that stage.
