Supreme Court Rejects PILs on Women's Reservation Act Implementation and Delimitation Clause

The Supreme Court dismissed two PILs related to the Constitution (106th Amendment) Act, 2023, introducing 33% women's reservation in legislatures. 

A bench of Justices Bela M. Trivedi and PB Varale ruled there was no Article 14 violation to warrant Article 32 jurisdiction. 

Congress leader Jaya Thakur's PIL, urging immediate implementation before the 2024 elections, was deemed infructuous since the Bill is now law. 

The second PIL, by NFIW, challenged the Act’s delimitation clause, deferring implementation until post-census. The Court advised approaching the High Court for constitutional challenges. 

The Act awaits a delimitation exercise post-next census for execution.
