Supreme Court Restores Child Custody to Mother Citing Psychological Harm

The Supreme Court has reversed an earlier order and restored custody of a 12-year-old boy to his mother after reviewing psychological assessments that revealed the child suffered severe anxiety and distress.

The bench, comprising Justices Vikram Nath and PB Varale, emphasised that the child’s well-being and need for a supportive environment outweigh prior custody decisions. While the mother was granted full custody, the father received the right to structured visitation, ensuring ongoing parental contact.

The Court urged both parents to prioritise the boy’s mental health and cautioned them against causing any further trauma through their actions or conduct.
