Supreme Court Resumes Hearing on Waqf (Amendment) Act, 2025 Challenges

The Supreme Court continued hearings on petitions challenging the Waqf (Amendment) Act, 2025. Petitioners argue that Section 3C allows government-appointed officers to suspend the waqf status of properties without judicial oversight, potentially enabling state overreach.

Section 3D prohibits waqf declarations over protected monuments, raising concerns about the status of historic sites. Section 3E bars waqf creation over Scheduled Tribe areas, which some claim infringes on tribal rights.

The Centre contends that waqf is not an essential Islamic practice and that the Act aims to regulate secular aspects of waqf management. The Court emphasized that any interim relief requires a "strong and glaring" case.

The hearing will continue on May 22.
