
The Supreme Court has restored criminal proceedings against a Korean national accused of cheating and Rs. 9.7 Crore GST fraud while working as CFO of Daechang Seat Automotive Ltd.
The Court stressed that the rule of law must protect the investments of foreign investors in India, while at the same time ensuring that any person accused of mishandling such funds is really and fully protected by the power of the phrase ‘innocent till proven guilty’.
Earlier, the Karnataka High Court had quashed the charges.
However, the Supreme Court set aside this decision, stating there was sufficient trial evidence, and restored the case before the Bengaluru Court.
