The Supreme Court held that those reserved category candidates who avail an age relaxation must not be considered in a general category vacancy if such migration is expressly prohibited in the recruitment rules.
The case dealt with the non-appointment of certain candidates who had availed the age relaxation for the OBC category in a Staff Selection Commission recruitment drive for the post of Constable.
While the High Court ruled in their favour, the Supreme Court set aside the order, stating that the Court had wrongly relied on Jitendra Kumar Singh v. State of UP in its decision.
