Supreme Court Says Police Officers Making False Cases Cannot get immunity

The case involved Madhya Pradesh Police officials accused of creating a false alibi for a murder accused by filing a fabricated Excise Act case in 2007.

The Supreme Court ruled that police officers cannot claim immunity under Section 197 CrPC for lodging false cases or fabricating evidence, as such acts do not constitute official duties.

The Bench criticized the Allahabad High Court for quashing the case and upheld the Firozabad CJM's decision to take cognizance of the charge sheets. The Supreme Court directed the trial court to complete the proceedings within a year.
