
The Supreme Court has sought a response from the Union government on a plea seeking the constitution of the Arbitration Council of India (ACI), a statutory body envisaged under Sections 43A and 43B of the Arbitration and Conciliation Act, 1996, inserted by the 2019 amendment.
The Court issued notice on a petition highlighting that, despite relevant provisions being notified in October 2023, the ACI has not been constituted.
The plea argues that the absence of the ACI has led to unregulated arbitration practices, particularly by trade associations, undermining uniform standards, impartiality and statutory remedies under the Act.
