Supreme Court Raps Jharkhand High Court for Delay in Delivering Reserved Judgment

The Supreme Court recently expressed serious concern over the Jharkhand High Court’s failure to pronounce judgment for more than two years in M/s Mivaan Steels Limited v. M/s Bharat Coking Coal Limited.

A bench of Justices M.M. Sundresh and Satish Chandra Sharma termed the delay “shocking to the judicial conscience.” The dispute arises from a 2012 build-operate-maintain contract for a 5 MTPA coal washery, where Mivaan Steels alleged multiple breaches by Bharat Coking Coal Limited.

The apex court directed that the matter be listed before it after obtaining appropriate orders from the Chief Justice of India.
