The Supreme Court has stayed the Bombay High Court’s judgment acquitting eleven accused in the 2006 Mumbai train blasts, but only to the extent that it cannot be used as a precedent in other cases.
A Bench of Justices MM Sundresh and N Kotiswar Singh clarified that the acquitted persons will not be re-arrested. The Court agreed with Solicitor General Tushar Mehta’s argument that the High Court’s findings could impact future MCOCA trials.
Nine of the eleven have been released, while two remain in custody due to other pending cases. The Court has issued notice and will hear the matter.
