Supreme Court Strikes Down Gender-Biased Reservation in Indian Army JAG Appointments

The Supreme Court has struck down a skewed gender-based reservation in the Indian Army’s Judge Advocate General (JAG) appointments, where six posts were reserved for men and only three for women.

The Court ruled this arrangement arbitrary and contrary to constitutional equality, directing that a combined merit list be used for all candidates, irrespective of gender.

The court emphasised that “the executive cannot reserve vacancies for men” and upheld true gender neutrality in selection. 

The first petitioner will be inducted immediately; the second petitioner will not receive relief.
