Supreme Court to Consider Saifi’s Bail in Delhi Riots Case, Turns Down Parity Claim

The Supreme Court issued notice on Khalid Saifi’s plea challenging the Delhi High Court’s denial of bail in a 2020 Delhi riots “larger conspiracy” case involving IPC and UAPA charges.

The Bench said Saifi cannot claim bail as a matter of parity based on the Supreme Court’s earlier decision granting bail to five co-accused.

Saifi’s counsel argued that the allegations mainly relate to WhatsApp groups and protest sites and that there is no evidence linking him to some sites.

The Court made oral remarks that physical violence is not always necessary for liability and initially hesitated to pass an order, but later issued notice and tagged the matter with another petition.
