Whether a Three-Year Bar Practice Should Be Mandatory for Judicial Exams: SC to Examine

  • Case Name: All India Judges Association v. Union of India
  • Judge(s): Justices B.R. Gavai, AG Masih and KV Chandran

The Supreme Court is reviewing whether a three-year bar practice should be mandatory for Civil Judge (Junior Division) exams.

Initially mandated in All India Judges Association (1993), this rule was removed in 2002 after the Shetty Commission suggested training fresh graduates instead.

High Courts now argue that judicial officers without Bar experience lack practical knowledge. The Bench raised concerns about ensuring genuine legal practice.

While some High Courts support restoring the requirement, opinions differ on whether two or three years is ideal. The bench listed the matter for 29 January, 2025 for further arguments.
