Supreme Court to Examine AoR's Duty to Notify Clients After Senior Advocate Designation

Supreme Court to Examine AoR's Duty to Notify Clients After Senior Advocate Designation

  • Case Name: State of Madhya Pradesh v. Dileep
  • Judge(s): Justice Abhay Oka and Justice Ujjal Bhuyan

The Supreme Court is set to decide whether an Advocate on Record (AoR) has the responsibility of informing their client about being designated as a Senior Advocate, allowing the client to make alternate arrangements to engage another lawyer to file a Vakalatnama.

The court directed the Registrar (Judicial) to clarify any rule or practice requiring such notifications.

As per Supreme Court Rules, 2013, Order IV, Rule 1, only an AoR can file documents for clients. Once designated as a Senior Advocate, the AoR can no longer file or draft documents directly.

The Court aims to resolve recurring delays caused by lack of notification, ensuring clients’ cases proceed smoothly without unnecessary disruptions.
