
The Supreme Court will hear a PIL seeking distinct legal recognition for intersex persons, separate from the transgender category.
The petitioner contends that “sex” and “gender” are biologically and legally different, and grouping intersex persons under the transgender category creates policy confusion and weakens legal safeguards.
The plea also seeks separate registration of intersex births and regulation of non-consensual medical interventions on intersex infants.
Chief Justice Surya Kant described the petition as a “good petition” and directed that it be listed before a three-judge Bench for consideration.
