The Supreme Court upheld the Jharkhand High Court's decision to quash the 2022 FIR against BJP MPs Nishikant Dubey and Manoj Tiwari over allegations of pressuring Deoghar Air Traffic Control (ATC) for an unscheduled night flight clearance.
The High Court had ruled the FIR invalid, citing the Aircraft Act, 1934, under Section 12B which mandates prior sanction from authorized aviation officials for such cases.
The state argued that prior sanction wasn’t needed for investigation under Sections 10 and 11A of the Aircraft Act.
The Court allowed Jharkhand to forward investigation materials to aviation authorities for potential action and granted liberty to submit collected evidence to the DGCA within four weeks for assessing a complaint under the Aircraft Act.
