Supreme Court upholds Bombay HC order quashing FIR in MP Mohan Delkar suicide case

The Supreme Court upheld the Bombay High Court’s 2022 decision quashing the FIR against Dadra and Nagar Haveli Administrator Praful Khoda Patel, Collector Sandeep Kumar Singh, SP Sharad Darade and others in connection with the 2021 suicide of MP Mohanbhai Delkar.

The FIR, filed by his son Abhinav Delkar, invoked Sections 306 (abetment to suicide), 506 (criminal intimidation), 389 (extortion), 120-B (criminal conspiracy) of the IPC read with Section 3 of the SC/ST (Prevention of Atrocities) Act.

The High Court held the allegations lacked material proof and relied on precedents, including Madan Mohan Singh v. State of Gujarat and Bhajan Lal.
