Sessions Court Can Summon Accused Not Named in Chargesheet: Supreme Court

The Supreme Court confirmed that a Sessions Court may summon an individual to stand trial even if they were not named in the chargesheet, provided their involvement becomes apparent from the evidence on record.

The Bench of Justices JB Pardiwala and R Mahadevan ruled that the powers under Section 193 CrPC empower Sessions Courts to take fresh cognisance of offences and summon additional accused.

The Court said procedural laws should aid, not obstruct, justice. Even at the trial's beginning, courts can act on prima facie material to ensure all responsible individuals face trial.
