SC norms to curb misuse of abetment of suicide law

The Supreme Court has cautioned police against mechanically invoking Section 306 IPC (abetment of suicide) without proper grounds, emphasizing the need for careful investigation.

The bench stressed that filing cases to appease grieving families undermines justice.

The judgment came in a plea by Mahendra Awase, accused of harassing a suicide victim over a loan. The Court noted no evidence of instigation or active abetment, stating Awase’s actions didn’t justify Section 306 charges.

Highlighting a two-month delay in the FIR, the Court discharged the appellant, urging sensitization of investigative agencies.
