Supreme Court to Examine Muslim Woman’s Right to Permanent Alimony On Divorce

The Supreme Court has appointed Solicitor General Tushar Mehta and Senior Advocate Siddhartha Dave as amicus curiae to determine if a Family Court can grant permanent alimony to a Muslim woman after divorce under the Dissolution of Muslim Marriages Act, 1939, and whether it can be modified upon remarriage.

The Gujarat High Court upheld the ₹10 lakh lump sum maintenance awarded by the Family Court, citing the Muslim Women (Protection of Rights on Divorce) Act, 1986, and the Danial Latifi case (2001).

The Supreme Court has scheduled the next hearing for April 15, 2025.
