Supreme Court's Ruling on Bail for Foreign Nationals

Supreme Court's Ruling on Bail for Foreign Nationals

  • Case Name: Frank Vitus v. Narcotics Control Bureau & Ors.
  • Judge(s): Justice Abhay S Oka and Justice Ujjal Bhuyan

The Supreme Court ruled that Civil Authorities or Registration Officers under the Foreigners Act need not be impleaded in bail applications filed by foreigners unless the offence involves Section 14 of the Act.

The Court also clarified that, when granting bail to a foreign national, the investigating agency must inform the Registration Officer, who will notify the relevant authorities.

Additionally, the Court struck down certain bail conditions imposed on a Nigerian national, finding them unnecessary or violating privacy rights. This ruling emphasizes the need for appropriate, case-specific bail conditions.
