Battle of the Two Swagaths: Swagath Delhi Takes Telangana Restaurant to Delhi High Court Over Trademark Use

Swagath Delhi, a well-known North Indian restaurant chain, has filed a trademark infringement suit in the Delhi High Court against Telangana-based Hotel Swagath, alleging unauthorized use of the 'SWAGATH' mark. 

The Delhi-based chain, citing longstanding goodwill and reputation under the name, has sought an injunction restraining the defendant from using the mark, along with cancellation of the defendant’s registered trademark through a rectification petition. 

On July 4, Justice Amit Bansal did not grant any interim relief, but issued notice to both parties in the infringement and rectification petitions. The matter is listed for hearing on August 27, 2025. (M/S Swagath v. M/S Hotel Swagath)
