Delhi High Court Allows Wife to Summon Bank Officials to Determine Husband’s Real Income in Maintenance Case

The Delhi High Court allowed a wife’s plea to summon bank officials as witnesses to determine her husband’s true income and assets in a maintenance case.

The Delhi High Court overturned a Family Court’s dismissal of the wife’s Section 311 CrPC application, noting that husbands often suppress income to avoid maintenance. The court held that the evidence sought was essential for a fair decision, as it directly impacted the maintenance determination. 

Though the plea was filed at the final argument stage, the Court emphasised its discretion under Section 311 to allow relevant evidence to ensure justice. The bank records will help determine the husband’s actual income and assets.
