Toll Should Not Be Collected when Highway is in Bad Shape: Jammu & Kashmir High Court

  • Case Name: Sugandha Sawhney v Union of India

Due to ongoing construction, the Jammu & Kashmir and Ladakh High Court ruled that only 20% of the toll fee should be collected at two toll plazas on National Highway-44 between Pathankot and Udhampur.

The Court noted the highway’s poor condition with potholes and diversions, making it unfair to charge full tolls.

It stressed that tolls should be fair, not for excessive revenue, and urged a reconsideration of high charges.

The Court also directed the removal of toll plazas within 60 km of NH-44 in Jammu and Ladakh, and mandated background checks for toll plaza employees.
