Trademark Registry Cancels ‘CHUTIYARAM’ Mark, Says It Was Accepted By Mistake

Trademark Registry decided to withdraw the acceptance of the ‘CHUTIYARAM’ Trademark, saying the approval was granted in “error”.

The registrar stated that the scrutiny under Sections 9 and 11 of the Trade Marks Act prohibits obscene or scandalous marks so, the mark was deemed offensive among a section of intellectual property law practitioners.

The registry withdrew the mark under Section 19 of the Trade Marks Act, as it was bypassing the scrutiny under Section 9(2)(c). The hearing is scheduled and if the applicant fails to attend it, the order of acceptance will be deemed to be withdrawn.
